Montgomery County Circuit Court License Department

The License Department sits inside the Montgomery County Circuit Court at 50 Maryland Avenue, North Tower, Room 1300, Rockville, MD 20850. Office hours are Monday through Friday, 8:30 AM to 4:30 PM. You can call (240) 777-9460 to ask questions before your visit or to book a civil ceremony appointment. The Montgomery County marriage license page at montgomerycountymd.gov is the best place to confirm current fees and any changes to procedures. The Circuit Court homepage covers all departments.

Montgomery County is the most populous county in Maryland. The license department here handles more applications each year than most other Maryland counties. That volume means wait times can be longer, so arriving early in the day is a good idea. If you have questions about parking at the courthouse, check the Circuit Court site for directions and garage options near 50 Maryland Avenue in Rockville.

Payment methods depend on how you apply. In person, the office accepts cash, money orders, cashier's checks, MasterCard, and Visa. If you submit a mail application for a certified copy, you must use a money order or cashier's check. Personal checks are not accepted for mail requests. Make checks or money orders payable to "Clerk of the Court."

Applying for a Montgomery County Marriage License

Both applicants must appear together at the License Department to apply. You cannot apply by mail or send just one person. Bring a valid, government-issued photo ID and your Social Security number. Under Md. Code, Family Law § 2-402, SSN disclosure is required. If either applicant was previously married, bring documents showing how that marriage ended, such as a divorce decree or a death certificate.

The license fee is $55. That is on the lower end for Montgomery County, though still significant. Under Md. Code, Family Law § 2-405, Maryland imposes a 48-hour waiting period after you apply. Your license becomes active 48 hours after you file. The clock starts from the time you submit your application, not from the time you pay. Once active, the license is valid for six months. If you do not use it within that window, you will need to apply again and pay the full fee.

Under Md. Code, Family Law § 2-401, a valid Maryland marriage license is required before any ceremony can be performed in the state. There is no way around that requirement, regardless of where the ceremony takes place in Maryland. The officiant is responsible for returning the completed license to the clerk's office after the ceremony.

Requesting Montgomery County Marriage Record Copies

Certified copies of Montgomery County marriage records cost $5.50 each. Plain copies cost $0.50. For most legal purposes, such as passport applications, Social Security name changes, or court filings, you need a certified copy with the official court seal. Plain copies are not accepted for those uses.

You can request copies in person or by mail. The official Montgomery County marriage record request form is available as a PDF. The form asks for the names of both parties (including maiden names or any previous names), the date of marriage if known, the license number if you have it, the number of copies you need, the total amount enclosed, and your name, address, and phone number. You do not need all those details to submit a request, but the more you provide, the faster the office can locate the record.

Mail completed forms and payment to: License Department, Montgomery County Circuit Court, North Tower, Room 1300, 50 Maryland Avenue, Rockville, MD 20850. Make payment to "Clerk of the Court." Only money orders and cashier's checks are accepted for mail requests. The Maryland State Archives marriage records order page is an option for older records not held at the county courthouse.

Civil Ceremonies at Montgomery County Circuit Court

The Circuit Court performs civil marriage ceremonies for $25. Cash or money order only; no cards for this fee. Ceremonies are by appointment; call (240) 777-9460 to schedule. You must have a valid marriage license before booking. Do not schedule your ceremony until the 48-hour waiting period has passed and your license is active.

Montgomery County limits civil ceremony attendance to 10 people total. That count includes both people getting married. So if you are a couple, you can bring up to eight guests. The ceremony itself takes about 10 minutes. Arrive at least 10 minutes early. If you are late, you may need to reschedule. That is a firm rule at this location. With 10 people as the maximum, attendance planning matters more here than at counties with a higher guest limit.

Historical Montgomery County Marriage Records

Montgomery County was formed in 1776. It is one of the original Maryland counties, and its records go back further than most jurisdictions in the state. Marriage licenses from 1798 to 1898 are held at the Maryland State Archives. Marriage records from 1865 to 1913 and from 1939 to 1980 are also at the Archives. Records from 1993 to the present are maintained at the county courthouse. For records between 1990 and 1993, the State Archives is the more reliable source.

The Maryland State Archives marriage records guide, at guide.msa.maryland.gov, explains what survives from different time periods and how to request specific records. Not everything from before 1900 is indexed, but a lot of the more commonly requested years have been organized well enough that searching is reasonably efficient. If you know the approximate year of a marriage, start there.

The State Archives at msa.maryland.gov is the primary route for pre-county-records research. Staff there can often help narrow down a search when exact dates are not known.

What Montgomery County Marriage Records Include

A Montgomery County marriage license lists both parties' full legal names, including any maiden names. It shows the date the license was issued, the date of the ceremony, and the name of the person who performed the ceremony. Witnesses are also named on the returned license. Recent licenses use a standard Maryland form. Older licenses, particularly those from before the mid-twentieth century, sometimes include more detail, like ages, birthplaces, and parents' names.

The People's Law Library page on marriage officiation explains who can legally perform ceremonies in Maryland and what rules apply to the return of the completed license. Officiants are required to send the signed license back to the clerk's office within a set time after the ceremony. That return is what finalizes the record. If an officiant fails to return the license, the marriage may not be properly recorded, which can cause problems later when someone needs to obtain a certified copy.

Name corrections require a separate process at the Montgomery County Circuit Court. If the name on a marriage record is incorrect, you must file a petition with the Civil Department. The fee for a name correction is $165, and a judge must issue an order under Md. Code, Family Law § 2-504 before the correction is made. That is more involved than correcting a typo on a driver's license. Plan accordingly if you discover an error on a Montgomery County marriage record.

The Archives index page helps researchers understand which years have been indexed and which still require searching through unindexed volumes. That distinction matters when you are estimating how long a search might take.

Other Ways to Search Montgomery County Marriage Records

The Maryland Judiciary Case Search is a statewide tool for looking up court case information. It does not give direct access to marriage license records, but it can help you track down related court actions, such as divorce proceedings or civil case filings connected to a marriage. The Montgomery County Records Page is another resource for searching marriage and other public records in the county. It aggregates data from multiple sources and can be useful when you need a broad search across different record types. For confirmed certified copies of official Montgomery County marriage records, the Circuit Court License Department remains the direct source. Third-party search sites can help you locate records and confirm details, but they cannot issue certified copies with the court seal. Only the clerk's office can do that.
